This course provides an overview of the history, the design of the system and the government, and the principles, doctrines and leading cases in subfields of the US Constitution. Learning the US Constitution not only helps us understand the foundation of the US legal system, but also serves as a resource to rethink constitutional issues in our country. 學習目標: In this class you will learn: 1. the history of the US Constitution; 2. separation of power and federalism; 3. due process of law and equal protection; 4. fundamental rights; 5. methods of searching, reading, briefing cases. 預期學習成果: After completing this class, students will: 1. have a general understanding of the framework and main topics of the US Constitution; 2. have an ability to identify, conceptualize and analyze constitutional issues. 3. be able to write clear, critical and persuasive legal documents and academic papers. 4. be able to engage charitably in discussion about constitutional issues. 上課方式..(實體教室 /網路同步/網路非同步) All available.
適合修讀對象:(專業能力、生活應用、國考準備、入學考試、其他考試或檢定、留學) This class will help students' preparation for studying abroad. 學生背景 : No requirements. 先修課程 : Basic understanding of the US or Taiwanese constitutional law is recommended. 外文能力 : Good English writing and speaking proficiency are expected.
Students are encouraged to browse SCOTUSblog (http://www.scotusblog.com/) to follow latest US Supreme Court cases. 課程資訊公告與問題反映 : E3 is available to discuss. 1. 作業 (30%): (1) Class presentation: Students should choose 1 case to brief and present in class. Student presentation starts from Week 5. The case-presenter is required to summarize the assigned cases and provide comments/reflections. The presentation should be around 20 minutes, with no more than 20 powerpoint slides. The case-presenter has to upload the powerpoints 48 hours before class. The presentation should be in English. (2) Reflections: Each student should choose cases to read and write a reflection (law graduate-3 cases, others 2 cases). The reflection should include at least 2 points--either questions, comments, or critiques to the case. The length should be around 300+ words in English or 600+ words in Mandarin. The reflection should be uploaded 24 hours before the class. *All the cases a student choose to present or to write reflections should be allocated in different weeks. (非同步、學分班可選擇) Reflection (30%, for students taking online course only): Students are required to choose cases to write reflections (law graduate staudents-4 cases, other-3 cases). The length should be 300+ words in English or 600+ in Mandarin. The reflection should be uploaded to the New e3 course website 24 hours before class, otherwise it would be deemed to be a LATE submission. Additional points could be earned by posting extra short questions/comments/responses with substantive contents on the e3 course website. Final Paper (70%): 2000+ words in English or 5000+ in Mandarin for graduate students; 1500+ words in English or 3000+ words in Mandarin for undergraduate students. The paper should describe an ongoing constitutional law issue (either in US, Taiwan or anywhere else) and analyze it with US constitutional doctrines and cases learned this semester. The paper MUST CITE cases or materials read in this semester. Students should prepare an informal oral presentation (less than 10 minutes, powerpoints not required) to explain their final paper ideas in Week 18. 2. 期中考:N/A 3. 期末考:N/A 4. 上課參與(實體): Class Participation : Attendance is mandatory. Students are expected to listen and actively participate the course discussion. Raising a substantive question/comment/response in class or on the e3 course website earns 1 point (maximum 10 points). The points of participation will be considered when grading the final paper. 上課參與(網路非同步):Students who cannot attend the real-time course should watch the class recording and check with the instructor via e-mail before the next class. 預期學習成果如何評量:From the class requests stated above, the instructor will grade each student appropriately.
