概述

This course is designed to provide students with an introductory understanding of the opportunities and challenges of applying medical science and psychology in law and judicial processes. It draws upon case studies from the fields of human rights and criminal law. In general, there is a growing recognition of the power of multidisciplinary approaches. But each discipline – including medicine, psychology, and law – is based on its own set of methods and theories, which are often conflicting. This course will explore how medicine, psychology and law intersect and influence each other. We will examine their different ethical approaches, working processes, and standards of examination, evidence and proof. We will see how these are reconciled through the legal system or, in many cases, remain irreconcilable.

教學方式

The course is based on the Socratic teaching method, which requires student participation in class discussion. In addition to lectures and class discussions, this course utilises a wide range of experiential and participatory learning methods, including practical exercises, simulations, and group presentations. All instruction, discussions, and assignments will be conducted in English.

評分方式

Class participation is expected and evaluated. Students who take this course for credit should be well prepared for each class and participate in class discussion. The final grade will consist of class participation (50%) and final group presentation (50%).

第 2 週Class 2: Standards of evidence and proof • Are the standards of medical and psychological evidence and proof compatible with legal evaluation? Case study: Proving Torture: in criminal, civil, asylum and human rights tribunals
第 3 週Class 3: Psychology of trauma • How does trauma effect the ability of victims to participate effectively in legal processes and present "legally" reliable evidence? Case study: Asylum and testimony: memory problems, motivated forgetting, stigma and vulnerability
第 4 週Class 4: Ethics • What are the best interests of clients and who knows best? Case study: Prisons: professional independence, client autonomy, disclosure, confidentiality and reporting requirements
第 5 週Class 5: Working procedures • What are the challenges of different working methodologies in collaboration? Case study: Field investigations: conflicts of time, process, framework, deadlines, approaches to client engagement and interviewing, follow-up
