概述
人類的歷史上有不同規模範圍的移民現象,其中有的是自願遷移尋找機會,也有被迫的離根流離,不管屬於何者,移民現象的產生並不只是移民個人的處境問題,而是呈現人類社會經濟和政治結構過程的產物,是國際間不同價值體制的差異或利益衝突的直接受害者,尤其是被迫遷移的難民群體,通常因為戰爭或貧窮,連根拔起遭受苦難與生存的困境,但這些問題並不是偶發的過渡現象,只要隨著迫使遷徙流亡的條件消失將能重回家園。歷史事實告訴我們,流亡的條件是否改變與是否能夠重回家園都不是必然的。 根據聯合國難民總署(United Nations High Commissioner for Refugees, UNHCR)《一九五一年關於難民地位的公約》第一條的定義,「凡有正當理由畏懼由於其種族、宗教、國籍,政治見解或於某一特殊團體遭到迫害,因而逃離了他或她的本國,並且由於此畏懼而不能或不願回國的人」根據聯合國難民總署公布的統計數據,2017年全球被迫流離失所的人數達歷史上新高到達6,850萬人,難民人數達到2,540萬人,歷史上最高峰。這樣的單年度增長速度是前所未見的,若以國家的人數相比,他們應是全球第24個最大的國家。 難民現象一直都是跨領域的議題,1980年代開始,以國際關係、法律、政治領域為主並擴及人類學、地理學、社會學等領域,也是當前全球化研究,以及民族國家與移民政策等重要的議題。本課程主要介紹在人類學和社會學的難民研究理論取向以及方法論。並以西藏流亡難民為案例,分別從基本的生存策略、難民安置與流亡政府、難民的身分與認同,探討難民處境,以及這些處境所觸及的研究議題。本課程的無國籍者的案例,分別以在臺灣和日本的案例,理解當代民族國家的國界關卡與移民政策如何造成流離。最後,以臺灣當前難民法在立法過程中的論辯為重點,檢視國境控管與人權政治。
