概述
課程概述與目標: 藉由跨國法律領域相關爭端解決裁決,包括國際公法、國際人權法、國際人道法、國際環境法、國際海洋法、國際商務仲裁、國際投資仲裁、世界貿易組織、國際商務爭端等領域案件之閱讀與摘要之製作,培養學生對於從事跨國法案例研究的能力,瞭解相關發展趨勢,並學習整理裁決摘要之研究方法。本課程的另一主要目的為讓學生瞭解案例閱讀方法,本課程經由實做方式,讓學生深入理解案例閱讀與分析、比較之方法。 主要課程內容包括: 1. 案例研究導論(含案例摘要與案例評論的說明)。 2. 國際人權法(公民與政治權利國際公約、經社文公約、反酷刑公約、消除種族歧視公約、消除婦女歧視公約及兒權公約等公約的個人申訴案件)與國際人道法案例研析(國際刑事法院的重要判決)。 3. 國際公法、國際環境法與國際海洋法案例研析。 4. 國際商務仲裁與國際商務爭端案例研析 5. 國際貨物買賣與仲裁案例研析 學習目標: 1. 掌握跨國法律領域之最新發展趨勢 2. 瞭解跨國法律領域當前或經典重要判決見解 3. 學習裁決之深入解析與案例研究方法 預期學習成果: 1. 明瞭跨國法律領域爭端解決之運作現況 2. 熟悉跨國法律領域之發展背景與最新趨勢 3. 養成獨立進行英文案件研究之能力
先修科目
本課程為跨國法律與談判學群之案例研析進階課程,學生應先修過跨國法學群核心或基礎課程方可選修。由於本課程修課同學須閱讀英文文獻(以判決、裁決、仲裁判斷等為為主),並於課堂中提出報告,學生必須具備良好的英文閱讀能力。本課程著重於訓練學生實際閱讀、理解與分析跨國法律領域爭端解決裁決的能力,修課負擔較重。
教學方式
首次上課將說明參考書籍及電子資料庫如何運用。 課程相關事項將透過課程助教及E3教學平台適時發布。
評分方式
案例選擇:每組必選二領域 案例分析期末報告(50%) 10/15 繳交個人案例初稿 (不含分析,一領域1500字,共3000字) 初稿會上傳E3,未來作為非報告組課前閱讀 期末個人報告12000字(兩個領域各6000字) 限中文撰寫(可以另外以英文投稿加分,但不可作為學期報告)
