法律倫理與專業責任

本學期的法律倫理課程,作法不同往年,與香港法學法學院的胡惠生教授(Richard Wu)與高一峰律師(Sebastian Ko)共同授課。胡惠生教授除了法律倫理之外,主攻電子商務法。高一峰律師是牛津大學法學碩士,香港法律科技的領導者,曾舉辦第一屆香港法律科技黑客松,DHB Global公司之創辦人,MIT Technology Review之global panel member。本學期課程主題是:COVID-19後疫情時代的法律執業創新、創意與倫理。包括兩大領域:(1)當代律師如何將創新與創意帶入執業之中,在全球化年代促進法律執業。(2)引導同學思考法律執業中嚴肅的法律與倫理問題。在範圍上,將介紹香港、澳洲、美國的相關實際案例,以及假設性案例。課程中預計將安排來自加拿大、澳洲、美國柏克萊大學法學院等國的來賓講者參與。 雖然課程以英文進行,但授課老師均是華人,學生可以用中文發問及撰寫期末報告 法律倫理,並不只是一門研究律師行為規範的學科。為了過符合倫理的生活,律師倫理學研究律師的執業環境、心理狀況等,並探討各種解決之道。在執業過程中,法律人可能遭遇巨大心理壓力,或面臨倫理兩難的抉擇。法律倫理學引導法律人降低壓力並進行倫理抉擇思考。本次課程特別強調mindful lawyering,真誠地進行溝通、行動及在日常生活中發展自我,進行創新。本課程將有新世代律師("NewLaw" practitioners)的參與,引領學生了解法律執業中的創新、創意與倫理。 Innovation, Creativity and Ethics in The Era of COVID-19 Course Description: In the era of globalization, lawyers face unprecedented legal, ethical and business challenges arising from the fast changing practice environment caused by such global crisis as COVID-19. However, globalized legal practice also presents new opportunities for innovative and creative lawyers. The Internet and other new media are radically transforming globalized legal practice. This course uses cutting edge hypothetical scenarios and real cases in Hong Kong, Australia and the United States to (a) teach how lawyers adopt innovation and creativity to promote legal practice and access to justice in the era of globalization and (b) expose students to the serious legal and ethical consequences that may follow from seemingly trivial decisions in legal practices. This course also teaches mindful ethics to help lawyers today and tomorrow cope with pressure brought about by globalized legal practice as well as global crisis like COVID-19. It shares insights on how legal mindfulness can help them reduce stress and develop ethical decision-making strategies. In particular, it teaches them how to practice mindful communications, mindful actions and mindful livelihood in their daily lives to develop themselves into innovative, creative and ethical lawyers. The course will include a research paper to afford students the opportunity to research on innovative, creative and ethical aspects (including mindful ethics) of legal practice in the era of globalization. This course will have an enrolment cap of [20] students to enhance the learning experience of students and the frequency and quality of interactions between students, teachers and guest speakers. Students will learn from innovative, creative and ethical lawyers, including “NewLaw” practitioners, and experts in mindful ethics. Course Learning Outcomes: At the end of this course, students who fulfill the requirements of this course will be able to:  recognize the role of innovation creativity and ethics in legal practice;  understand how innovation and creativity can generate novel ideas and solutions for legal practice;  appreciate how mindful ethics can reduce stress caused by globalized legal practice and global crisis like COVID-19 and improve the well-being of lawyers;  harness the powers of innovation creativity and mindful ethics to identify alternative models of legal practice and promote access to justice.

本課程係針對法律人執業環境可能遭遇的倫理情境而作討論,故修課者應具備基本法律實務相關知識,主要是訴訟法等程序法規。應先修畢民法債編總論、民事訴訟法、刑事訴訟法、以及憲法,或相對應這些課的英美法課程,並具備良好英文閱讀能力。

教材編選:以中英文案例為主。問題討論為輔。並佐以相關中英文文獻作延伸閱讀。 教學方法:以理論演講及案例討論及為主。同學應報告負責部分之閱讀教材,並嘗試回答教材所列問題。 由於法律倫理難題的具體情境,往往很難只用文字表述,因此本課程會輔以法律電影的欣賞,以協助同學體會其情境。

1. Class Participation (10%) 2. Reflective Essay (55%) 2,000-word (4000 words if in Chinese) piece of essay reflecting upon the discussions in the seminars about innovation, creativity and ethics in globalized legal practice and experiences of interacting with lawyers and experts of the field. Suggested themes include: (a) innovation and creativity in legal practice (b) mindful ethics and (c) alternative models of legal practice. 3. Group Project (35%) Group project presentation on a topic of innovation, creativity and ethics in legal practice set by the course coordinators, with a 1,200 – 1,500-word of project report on the findings
