研究對象權益之保障與法律議題

一、課程目標 1.瞭解以「人」為研究對象之倫理與法規 2.探討研究對象權益保護之實務案例 3.學習研究計畫審查內容及參與者同意書之撰寫 The goal is to: (a) understand the research ethics and regulations of human subject research,(b) explore the case of protection of research subjects rights, and(c) learn to write research protocols and consents of research subjects. 二、課程概述 保護以「人」為研究對象之權益,已成為研究者應遵守的普世價值。我國於2011年12月28日公布施行之《人體研究法》,即是落實人體研究有關研究對象之保護,並且要求研究者進行研究前,應擬定研究計畫,經倫理審查委員會審查通過,始可為之。再者,以「人」為研究對象之相關法規,尚有《醫療法》、《人體試驗管理辦法》、《藥品優良臨床試驗作業準則》、《醫療器材管理法》、《醫療器材優良臨床試驗作業規範》、《人體生物資料庫管理條例》、《個人資料保護法》,故研究者進行研究時,亦應注意上述法規有關研究對象保護之特別規定,以免觸犯法令規定。是以,本課程首先是要讓學生瞭解研究倫理概念與相關規範,包括研究倫理之源起、原則與法令,以重視研究倫理之重要性。其次,透過實務案例之討論與分析,讓學生認識有關研究對象權益保護之法規內容,避免違反法令規定。最後,協助學生撰寫研究計畫書與參與者同意書,以申請倫理審查委員會之審查。 本課程設計包括:1. 以「人」為研究對象之研究倫理與相關法規的講授。2.個人書面報告及討論。3.專家演講研究倫理相關議題。希冀同學進行有關「人」的研究行為符合研究倫理與相關法規之規定,並且有撰寫研究計畫書與參與者同意書之能力,獲得倫理審查委員會之審查通過,讓研究行為具有正當性及合法性。課程適合研究所同學與大學部專題研究生選修。 The protection of research subjects rights has become a universal value that researchers should observe. The “ Human Subjects Research Act" took effect on December 28, 2011. This Act is specially stipulated to regulate the right protection of human research subjects. Prior to conduct a research, the principal investigator shall submit the research protocol for review and approval by the Institutional Review Board (hereinafter “IRB"). Furthermore, the relevant laws and regulations on protection of research subjects rights include the “ Medical Care Act", “ Regulations on Human Trials ", “ Regulations for Good Clinical Practice", “ Medical Devices Act",“ Good Clinical Trial Practice Regulations for Medical Devices" ,“ Human Biobank Management Act", and “ Personal Data Protection Act". Therefore, before conducting research, you should also pay attention to the special provisions of the above-mentioned laws and regulations on protection of research subjects to avoid violating laws and regulations. This course is to enable students to understand the concept and related norms of research ethics, including the origin, principles and regulations. Secondly, through the discussion and analysis of cases, students can understand the contents of regulations related to protection of research subjects rights. Finally, students can learn to write research protocols and consents of research subjects to apply for review by IRB.
