本課程是美國法的進階課程,主軸為美國聯邦證據法、但部分議題會藉由美國法案例及加州證據法顯示證據法爭議處。使用模擬卷證作為上課教材。 所謂證據法指的是美國訴訟律師、檢察官以及法官在法庭中所使用的訴訟規則,是篩選證據最主要的工具,讓證據能在被充分辯論後才進入審判,讓事實決定者知悉。我國目前刑事訴訟法只有簡易版的證據法規則(關聯性、傳聞、拒絕證言),美國法上針對證據法則有更深入的經驗與研究,是值得我國借鏡的重要法律領域。此外,證據法很大一部分談的是偏見、認知負荷,是心理學與法律學交會的重要領域,歡迎大家來一同探索。 本課程並無期中考試,評量主要依據是上課出席、表現以及期末口筆試。 本課程目標有三: 1. 能解釋美國聯邦證據法的基本概念與內容 2. 能辨識證據法中的重要爭點 3. 能在模擬案例中活用證據法規則進行辯論 本課程重視上課互動,設修課人數上限40人。 *本課程之非同步課程無法有課堂中之互動,僅供學分班同學選修,科法所與大學部同學須至教室實體上課。 **本課程實體授課地點為台北北門校區,新竹教室遠距,授課老師極為重視課堂互動,科法所碩專博學生須實體到台北上課至少7次(其中必包括期末口頭考試;期末筆試若在台北考試不計入次數),此要求為評量之基礎,請同學們斟酌選課。
學生背景: 本課程為美國法之進階課程,以刑事程序為主要討論範圍,學生應具備我國刑事訴訟法之基礎。適合有意從事訴訟實務工作者、有意以證據法為研究領域之同學。 先修課程: 刑事訴訟法。 外語能力: 上課語言以中文為主,混用英文,教材為英文。上課時學生可以選擇以中文或英文與老師互動。
Reading materials will be entirely in English. Class will be conducted mostly in Chinese, but parts of the presentation may be in English. The final exam will be in English, but the final oral exam can be conducted in both Chinese and English. English ability is not a prevailing factor for grading.

Excerpts of: (i) the Federal Rules of Evidence, (ii) the California Evidence Code, and (iii) U.S. case law. The rules and cases are readily available online. Instructor will provide the excerpts after each class. If desired, students may wish to purchase the latest edition of the Federal Rules of Evidence.
