Course Descriptions and Objectives: This course acquaints students with Tort Law as it is practiced in the United States, and offers comparisons to Tort Law in other countries such as Japan, Taiwan, the U.K., Australia, and EU nations. We will cover selected aspects of intentional torts, negligence, and strict liability, with special attention to medical and products liability issues. Our objectives include comprehension of both legal and policy issues in personal injury law, as well as the enhancement of students’ ability to research and discuss legal and policy issues in English. Free expression of opinions and debate is encouraged. Students may participate online, either synchronously or asynchronously. However, in-person attendance in the new classroom on the NYCU campus is preferred.
Required competence or courses that must be previously taken by students: Any first-year course in civil or common law that covers personal injury issues, in Taiwan or other nations. (Other students may be accepted in the instructor’s discretion, including students and professionals with non-legal backgrounds. It is not hard to learn the basics of Torts.) Students should have good comprehension of spoken and written English.
Description of Course Details: 1. Homework and Assignments: Assigned each week. 2. Exams and Quizzes: Ungraded practice exam; occasional quizzes as needed; final exam. 3. Evaluation and Grading Policy: Explained in the Syllabus distributed in the first class. Some credit is given for attendance, active participation, and completion of assignments. Most credit is based on the final exam. Extra credit is possible for contributions beyond what is assigned. 4. Pedagogy, other supplementary information (websites, TAs, handouts and databases): Websites to current issues and controversies; TA to be named; handouts provided.
