Course Description: This course presents the student with techniques for effective writing in the legal environment. Through various readings and writing exercises, students will learn how to structure arguments, explain the law, and organize information for a variety of legal documents. Students will learn and practice the basic skills necessary for identifying, locating, and using legal resources, including primary sources of statutory and case law; secondary authority; and research reference tools commonly used in the practice of law. Students will also be introduced to basic Bluebook citation methods. Students will explore the process of legal analysis, incorporating the results of their legal research into various legal documents. Course Objectives: At the conclusion of the course, you will be able to do the following: 1. Evaluate and understand the purposes and key elements for various types of legal written work products; 2. Recognize and employ various writing techniques to construct clear, concise, and precise sentences, paragraphs, and contract clauses; 3. Evaluate and understand legal authority structures, identify legal issues, assess source credibility and accuracy, and formulate a line of legal reasoning using those sources; 4. Employ various outline and structure rules and arguments to produce organized and coherent legal writing; 5. Use sound methods of legal research; and 6. Properly attribute sources in legal writing, and be able to cite to cases, statutes, regulations, and secondary sources in Bluebook format. Policy Regarding Collaboration: The principal goal of this policy is to ensure that each assignment a student submits is the student’s own work product. To that end, students may collaborate with other classmates with regard to the content of an assignment, the general plan of research, and the general approach to the problem presented. However, students must work independently during the writing process. Students are encouraged to bring concerns or questions about this policy to the professor.
Language: This class is taught in English. However, students do not need English skills in excess of those required by the university for admission. Prior Study: Prior study of legal writing is favorable, but not required or necessary. Class Participation: Thorough preparation, timely arrival, regular attendance, active participation, a supportive attitude toward your classmates, and timely completion of all assignments are expected. In the classroom I use a combination of an interactive lecture-discussion method, so you may be called on.
